1. Introduction

It is very important that you read this document carefully before you proceed to payment.

By accepting this Membership Agreement, you are entering into a legally binding contract, so please consider carefully whether this Agreement is right for you and contact me before you purchase if you have any concerns.

If anything in this Membership Agreement is unclear, please seek independent advice to ensure you fully understand your rights and obligations. I encourage you to negotiate any clause of this Agreement which feels unfair to you.

It is my aim to help you improve your money confidence, however, I recognise that from time to time there may be reason for some dissatisfaction. We welcome constructive feedback as an opportunity to review and improve our practices. Please feel free to contact me at laurie@budgetbeyond.com.au to discuss any issues that arise.

This program is designed specifically for female business owners and entrepreneurs who are, or soon will be, completely dependent on their business income to provide for their household needs.

(a) Important Dates

  • (i) This is an ongoing monthly membership program with no set start or finish dates.
  • (ii) Membership commences from the date of your first payment.
  • (iii) Membership concludes when you discontinue your payment arrangement.
  • (iv) If you have purchased an annual subscription, your membership automatically renews in 12 months from your initial payment.

(b) The Parties

In the rest of this document, the entity providing the membership will be referred to as Budget Beyond
You, the “Member”
By accepting this offer, you personally agree to become a member of the Money Confidence Academy and to be bound by the terms of this agreement.

(c) Contact

  • (i) Feel free to contact Laurie Griggs during normal business hours via email at laurie@budgetbeyond.com.au
  • (ii) I may not respond to you immediately. I usually go through my emails twice a day and respond to anything urgent. This may mean that I get back to you within a day or two. I probably won’t get back to you via email on the weekend or public holidays. I like to reserve that time for being with my family.

2. Definitions and Interpretation

(a) Definitions

The following words have these meanings in this Membership Agreement:

  • Facebook Group means the Money Confidence Academy Community. This is a Secret group available only to members of the Money Confidence Academy. Posts made in the group cannot be seen or shared with anyone outside the group;
  • GST means goods and services tax or similar value added tax levied or imposed in Australia pursuant to the GST Act or otherwise on a supply;
  • GST Act means a New Tax System (Goods and Trading Tax) Act 1999 or any amending or replacement legislation;
  • Intellectual Property Rights means all statutory and other proprietary rights and interests including copyrights and all rights in the nature of copyright, patents, pending patents, trademarks, service marks, trade names, domain names, designs, methods, database rights and all other intellectual property rights;

3. Payment

(a) Payment Terms

  • (i) You agree to pay membership fees as follows:
    • a. Monthly fee of $60 or
    • b. Annual fee $495
  • (ii) Membership payment is due at time of enrolment
  • (iii) Payment must be made through the website payment portal using Stripe.
  • (iv) Membership is charged in Australian Dollars.
  • (v) Prices are inclusive of GST.
  • (vi) Occasionally there may be specials and promotional offers which differ from the above price. If there is a current promotion running, the price will be stated at sign up through the website.

(b) Late Payments

If a recurring payment fails to complete, a reminder will be sent by email with 7 days to update your financial details. After 7 days if payment is not completed your membership will be terminated and you may be at risk of losing your lower membership rate if price rises have occurred since your enrolment.

No late payment fee will be charged, however, your membership will be cancelled losing any discounts if you decide to rejoin the membership program after a price rise.

(c) Withdrawal from Membership

  • (i) If you have purchased a Monthly Membership, you are entitled to a 28 day money back guarantee after the first 28 days only. After which you may choose to cancel your membership at any time by providing 28 days notice by written request to laurie@budgetbeyond.com.au
  • (ii) If you have purchased a Yearly Membership, you are entitled to a 28 day money back guarantee, less a $20 administration fee, within 28 days of payment received by providing a request in writing to laurie@budgetbeyond.com.au. If you do not wish to renew your membership at the end of 12 months, a written request is also required to be send to laurie@budgetbeyond.com.au before the 12 month anniversary of your last membership payment.

4. The Membership

(a) Membership Content and Structure

  • (i) Money Confidence Academy is a long term support program for female business owners and entrepreneurs who are struggling with their finances to transform their money confidence through managing their business and personal cash flow systems and achieve their lifelong goals.
  • (ii) Members receive access to 8 video modules and workbooks for the Personal Financial Fundamentals course, 10 video modules and workbooks for the Profit First Business Fundamentals course, access to a supportive Facebook community and a monthly live workshop with a question & answer session and recording.

(b) Cancellation of Scheduled Calls

  • (i) If a workshop or scheduled live call needs to be cancelled we will endeavour to either reschedule for another time within the month or make it available as a recording.
  • (ii) Unexpected circumstances such as illness or family need may cause a scheduled live session to be cancelled or postponed.

5. Budget Beyond Responsibilities

(a) Obligations

  • (i) It is my duty to supply the content and resources listed in part 4 (a)
  • (ii) It is the duty of Budget Beyond to provide up-to-date educational resources, research and information to the best of my abilities.
  • (iii) It is my duty to manage, monitor and maintain a respectful space within the Facebook group.
  • (iv) It is my duty not to provide financial planning or tax advice, general or otherwise. My role is to exclusively provide educational content and information only.
  • (v) It is my duty to respond promptly to any questions tagged to me within the facebook group, messenger or email within a reasonable time frame.

6. Member Responsibilities

(a) Obligations

  • (i) As a participant in the Program, you understand that you are expected to:
    1. Attend all live and recorded calls, tutorials or lectures to enable you to progress through the Program requirements.
    2. Be non-judgmental, respectful and positive in all communications within the group at all times.
    3. Contact the presenter at any time you experience any difficulties or challenges during the Program or require personal support for any reason.  Personal support may require additional paid sessions with the presenter depending on complexity of issues or challenges.
    4. Complete all modules, attend all calls and apply all practices.
  • (ii) You accept and agree that you are fully responsible for your progress and results from the Program
  • (iii) You accept and agree that you must complete the Program requirements to obtain the full benefit of the Program
  • (iv) You accept and agree that individual results may vary and that it is possible that you may not achieve the expected results and that the outcome is dependent upon your participation and personal skills and abilities and not the responsibility of the presenter or Budget Beyond.
  • (v) You accept and agree that you are to maintain a respectful environment within the facebook community. Any disrespectful comments or behaviour may result in being removed from the facebook group, with no grounds for a refund. You may still maintain access to the course videos if you request permission and receive a written agreement.

(b) Indemnity

  • (i) You have engaged Budget Beyond’s services and purchased products at your own risk and that all programs are provided as an educational and informational service or product only.
  • (ii) The presenter is not a tax or insurance agent, financial planner or adviser.
  • (iii) The presenter does not give general or individual advice on financial products.
  • (iv) Members who are ready for investing or who need life insurance and superannuation products are referred to a Licensed Financial Advisor.
  • (v) You shall refer any financial questions (including investment and insurance questions) which may arise to qualified professionals.
  • (vi) Budget Beyond and the presenter does not offer any representations, warranties, or guarantees, verbally or in writing, regarding members results from any program.
  • (vii) Results are dependent on various factors including but not limited to, commitment, online skills, personal ability, and dedication, and in no way dependent on any information the presenter or Budget Beyond provides to you.

(c) Resources

  • (i) Members need a computer and reliable internet access.
  • (ii) Facebook & Zoom are required in order to participate effectively in the membership.
  • (iii) Do not share the recordings and modules to anyone outside of this membership.

(d) Membership Details

It is your responsibility to ensure that your contact details provided by you in the membership site remain correct and up-to-date. These details will be used to maintain our database of current members, notify you of changes to the Money Confidence Academy and provide you with updates to ensure you get the most value from your membership. Should your details change at any time you must notify Budget Beyond of the change as soon as possible.

(e) Correspondence

The best method of additional correspondence is through the Facebook Group, Messenger within the Money Confidence Academy website and email.

(f) Non-competition

  • (i) You may not use any of the materials available on this platform or within any program created or owned by Budget Beyond in a manner that infringes any of our rights or that has not been authorised by us.
  • (ii) All programs and materials available on this platform and within any program created by Budget Beyond are the property of Budget Beyond and/or our directors or licensors, and are protected by copyright, trademark, and other intellectual property laws.
  • (iii) All material including but not limited to course content, manuals, videos and all other material is provided solely for your personal non-commercial use.
  • (iv) You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from this platform or any program without the express permission of Budget Beyond. You may request such permission by emailing laurie@budgetbeyond.com.au
  • (v) Videos and worksheets supplied by Profit First Professionals are used with permission and remain the property of Profit First Professionals. You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any of the videos or worksheets supplied by Profit First Professionals without the express permission of Profit First Professionals. You may request such permission by emailing rons@profitfirstprofessionals.com
  • (vi) The Snow Ball Debt Calculator is used with permission by Vertex42 and remains the property of Vertex42. You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any of the worksheets supplied by Vertex42 without the express permission of Vertex42. You may request such permission by emailing nexus@vertex42.com

(g) Providing Services to Other Members

No business promotion is allowed in the Facebook group, however the member can introduce themselves and include their business with a #intro post.

7. Relationship of the Parties

  • (i) The [Member] engages Budget Beyond to provide the Money Confidence Academy Membership through its employees and agents. The relationship between the [Member] and Budget Beyond is that of a principal and independent contractor.
  • (ii) Nothing contained in this Agreement will constitute or deem Budget Beyond or any of its employees or agents to be a partner, employee or agent of the [Member] or vice versa.

8. Disclaimer

(a) Important Information

  • (i) You have engaged Budget Beyond’s services and purchased products at your own risk and that all programs are provided as an educational and informational service or product only.
  • (ii) Budget Beyond and the presenter does not offer any representations, warranties, or guarantees, verbally or in writing, regarding members results from any program.

(b) Source of Claims

The information supplied in this Program come from my own extensive research, education and experience including owning my own current and past businesses, my employment experience and results achieved by my current and past clients.

(c) Guarantees and Warranties

  • (i) If you have purchased a Monthly Membership, you are entitled to a money back guarantee by written request to laurie@budgetbeyond.com.au within the first 28 days only.
  • (ii) If you have purchased a Yearly Membership, you are entitled to a money back guarantee, less a $20 administration fee, by written request to laurie@budgetbeyond.com.au within 28 days of membership payment received only.
  • (iii) I do not guarantee your individual results as these depend on several factors including your mindset, actions, time dedicated and consistency. Results have been based on previous and current client experiences.

(d) Limitations

Budget Beyond or the Presenter is not responsible for any comments, answers or advice supplied by other members within the facebook group.

9. Intellectual Property & Privacy

(a) The Griggs Family Trust Confidential Information

From time to time in videos, worksheets, workshops and webinars, I may share examples using my own business as a reference. The information shared is to be kept confidential within the Money Confidence Academy, are restricted to copy right and is to be used for educational purposes only.

(b) Copyright

All programs and materials available on this platform and within any program created by Budget Beyond are the property of Budget Beyond and/or our directors or licensors, and are protected by copyright, trademark, and other intellectual property laws.

(c) Your Confidential Information

Any personal or business information collected by Budget Beyond will not be passed on, used or sold to any third party.

10. Dispute Resolution

  • (i) If either of us have a problem or complaint relating to this Agreement, we agree to discuss the issues and make a genuine effort to resolve them through negotiation.
  • (ii) If we are unable to reach a mutually acceptable compromise on our own within 21 days, we agree to seek mediation through the Dispute Resolution Centre: https://www.qld.gov.au/law/legal-mediation-and-justice-of-the-peace/settling-disputes-out-of-court/mediation.
  • (iii) We agree to share any costs of mediation equally between us. Neither of us may commence litigation until we have first submitted the dispute to mediation.
  • (iv) Mutual Non-Disparagement: We agree to use our best efforts to resolve any problems amicably and in good faith, and to refrain from any conduct or communication which might reasonably be expected to interfere with the business and/or personal interests of the other.

11. Limitation of Liability

  • (i) In no event shall Budget Beyond be liable to the Member for costs, loss, injury or damage to the Member or the Member’s belongings [that is not directly attributable to the negligence of Budget Beyond or its employed staff].
  • (ii) You agree that your participation in the Membership, including all activities, accommodation and travel associated with the Membership, is entirely voluntary. You expressly agree to accept all risk of injury and/or damage that may arise from your participation.
  • (iii) You expressly agree that if this clause is unenforceable for any reason, Budget Beyond’s total cumulative liability for all causes of action of any kind shall not exceed the amount paid to Budget Beyond under clause 3(a)(i) and 3(a)(vi).

12. General Provisions

(a) Jurisdiction

The validity, interpretation and performance of this Membership Agreement will be governed by the law of Queensland, Australia.

(b) Whole Agreement

This Membership Agreement comprises the whole agreement between the parties concerning the Membership and replaces any prior agreement, arrangement or understanding regarding the Membership.

(c) Variation

Any variation to this Membership Agreement must be agreed on in writing.

(d) Survival of clauses

Clauses 3, 9, 10, 11 and 12 are essential terms of this Membership Agreement and survive the termination of the Agreement for any reason.

(e) Severability

If any part of this Membership Agreement is held to be void, illegal or unenforceable, it can be removed without affecting the validity, legality or enforceability of any other part of this Membership Agreement.
